Motion was made by Christopher Pryslopski, seconded by Dan Paashaus to approve Area Variance Z2011-05 for Pinecrest Indoor Tennis for the height variance for a proposed building to be located at 658 Route 32. The variance is for the minimum height necessary for the business, and presents no visual impact noted to neighbors or from the roadways (Route 32). This approval is conditional upon Pinecrest Self Storage LLC coming into compliance with specifics laid out by the Code Enforcement Officer with regard to its Site plan.

Pursuant to Municipal Law #239-m the UCPB has 30 days to take action, the deadline for this action will be Oct 28, 2011.If nothing is received from county a decision can be made at the next ZBA meeting scheduled for Nov 15, 2011.
This application will be put on the Agenda for the Nov meeting.

A public hearing was opened on the Pinecrest Indoor Tennis # Z2011-5 for an area variance for the proposed facility to be a max height of 38 ft.
As requested by the board the balloons are being flown in the location of the proposed building. Chairman Parenti did a site visit and verified the height of the balloons.
Other members visited the site and could not see the balloons from the storage shed area located on Route 32.

Motion was made by Christopher Pryslopski, seconded by David Soman to approve the July 19, 2011 as amended. Correction to item #3 under Old Business so that the word “owners” is spelled o-w-n-e-r-s-' (plural possessive).

III. Public Hearing:
A public hearing was opened on the Catherine Parrinello application Z2011-4 for an area variance which would permit the home she has been repairing to be a two-family residence on an undersized lot, located at 1829 Lucas Avenue.
Ms. Parrinello stated that the home was extremely dilapidated, large and formerly a two family.
Patricia Berlanga, a next door neighbor voiced concerns over well water quantity and quality as well as adequacy of the septic system. She also noted that the former owner was denied a variance for an apartment. Ms. Parrinello stated only septic issue she was aware of was interior and corrected, and well is separate, not shared. Ms. McKenzie asked about depth of their wells. Ms. Parrinello stated 125 feet and Ms. Berlanga said she did not know, but it is a drilled well.
Ms. Berlanga stated her well was there when she purchased the property in 1969 and the septic tank and drain field were replaced in 2008. Ms. Parrinello stated her property was purchased on foreclosure, no septic violations were found on file with Ulster County Health Dept. or Rosendale Building Inspector's Office. Ms. Berlanga noted that bedrock is not far below the surface in this area and the septic on the Parrinello property failed at one point approximately 15 years ago.
Mr. Parenti recommended that Ms. Parrinello have the septic evaluated for adequacy and well water flow certified by a professional, as well as the water quality tested by the health dept. She agreed to have the tests completed, asked if documentation from Wolven would be satisfactory to address the first two items and that was deemed acceptable to the ZBA. Mr. Greitzer noted that the submission deadline for the next meeting is September 6th.
Motion was made by Christopher Pryslopski, seconded by David Somen to close the public hearing on the Parrinello application for an area variance, subject to the condition that the ZBA accept written comment on this matter for the next two weeks.

Motion was made by David Soman, seconded by Ron Parenti to grant a use variance #Z2011-3 to allow Matt Igoe to operate a distillery at 473 Hickory Bush Road based on the applicant having met all four criteria required for approval of a use variance as set forth in the Town Code.

V. New Business:
Pinecrest Indoor Tennis Z2011-5 Area Variance
Charles Wortmann, owner of Pinecrest Storage on Route 32, and his partner Rich Cusanno, presented application Z2011-5 for an area variance to permit construction of an indoor tennis facility (Pinecrest Indoor Tennis) with an exterior maximum height of 38', code limits the height to 30' outside the hamlet of Rosendale, noting 40' is permissible inside the hamlet. Mr. Wortmann provided a site plan and topographic map to the ZBA. He stated there would be two courts enclosed and that USTA requires 35' floor to ceiling indoor height and would not be visible from Route 32. Mr. Parenti asked if it would be visible from the Thruway and if there would be signage in that direction. Mr. Wortmann stated he did not know if it would be visible from that direction though it is wooded and he is not really interested in such signage. Mr. Cusanno stated that sinking the floor would not be option since that would not allow for drainage, and he noted it will be a soft court, with radiant heat from above. Mr. Wortmann stated the facility is intended for serious players and it would significantly affect business if the courts did not meet regulations. Mr. Wortmann stated that he has biologist (Zawicki) preparing wetlands delineation and plans for the Army Corps of Engineers. He hopes to be shovel-ready by spring.
The ZBA requested a balloon test whereby red or orange balloons are placed 120' apart at each contour from 184' to 192', so that there are four sets of two and one at the 192' elevation. The test will be conducted September 15-25 and notification of such test will be contained in the public hearing notice.

Buthman Area Variance -Z2011-6
Brant and Lisa Buthmann of 17 Rose Avenue,Tillson presented application for an area variance to permit construction of a garage that would not meet setback requirements. After discussion and review of their site plan, the Buthmanns decided to revise the site plan, withdraw their application to the ZBA and revisit the building inspector.

Aleo – Z2011-1 Area Variance
Review received from UCPB stating No County Impact
Myles Putnam consultant for Mr. Aleo addressed the board prior to deliberation by the board.
Board members feel this variance is substantial and primarily for economic gain.
The questions about Lot #7 and the sale in November came up again. If this lot was not sold Mr. Aleo would not have needed a variance for this project. The water and sewer line extension were also discussed.
Manna Joe Green suggested possibly changing the density for Zoning. This issue was discussed during numerous meetings and the Zoning Board can not change the current zoning laws, they can only review and recommend changes.
Motion was made by Ron Parenti, seconded by Christopher Pryslopski to deny application #Z2011-1 for the requested area variance based on variance being of substantial request and solely for additional financial gain.

Public comments:
Manna Jo Greene (as a concerned citizen) shares concerns over setting precedence. This variance appears to be a self created hardship (with the selling of the adjacent lot) and she suggested that the applicant ask the Town Board to rezone this area for a greater density schedule.
No other comments from the Public were taken.
Mr. Aleo would like to construct a two family dwelling on Lower James St which requires an Area Variance.
A letter was received from the Water/ Sewer Superintendent Terry Johnson and a copy of the Agreement between Mr. Aleo and the Town of Rosendale.
Recommendations from the Planning Board concerning this Variance were also received.
ZBA requested the applicant to provide an updated drawing to show the changes to the elevation, building size (footprint) and to show on the plat the existing house located behind this proposed lot.
Ron Parenti stated this is a significant variance being requested, roughly a 66% area variance.
Ron Parenti stated a single family home on this property would not require a variance. Mr Aleo stated he has made significant improvements to the neighborhood, he is requesting this Area variance for economic reasons.
Question was asked by the Board concerning the type of material being used for the parking area, concerns with this lot and the storm water run off. Stone will be used.
Chairman Parenti requested records from the applicant regarding the sale of the property adjoining this lot.

Definition of Livestock was discussed. ZBA members discussed that the current code is vague in regards to allowing chickens, the Town Board can write a new code to allow chickens in various zoned area through out the Town of Rosendale. ZBA can not change the code but is willing to work with the Town Board on this issue.
CEO asked how issues like this will be handled in the future. Answer given by the ZBA: Case by Case.

The following Variance was approved
1.) The Zoning Board of Appeals of the Town of Rosendale hereby approves application #2010-5 for an Use variance for Nathan Ermer and Naja Kraus to allow their (6) existing pet chickens to live out their natural life at the applicants residence of 46 Parkcrest Drive, Rosendale, New York.
2.) The existing property with six chickens comply with the bulk requirements allowed in a R1 zoning district.
3.) Approval of this variance is subject to the condition that upon their demise the chickens will not be replaced.
4.) The variance requested observes the spirit of the law and would not change the character of the district. The applicant took it upon herself to call the Town and ask about the law regarding chickens before purchasing their home and was told chickens were allowed in said zoning district.
5.) Applicant went to all the immediate neighbors with a Petition explaining her situation and also told them there was not a rooster on the premises. No negative impact comments were received.

Any alterations to the sign’s size location, height or appearance to include illumination will require a new Sign permit issued from the Building Department.
The variance granted observes the spirit of the law and would not change the character of the district since it is the minimum variance deemed necessary and adequate for this purpose and at the same time will preserve and protect the character of the neighborhood.

Applicant is requesting an Area variance for the church sign and lighting of the sign.
New sign is 4x8 which also houses two fluorescent lights which shine directly on the sign.
Frank Houtaling talked to Tom Fiore two weeks prior to receiving the violation notice said the church did not need any permits. He also stated that the neighbor had agreed to put the sign on a timer.
Joan Ryan – asked if members of the Board had been on a site visit? All members have been on the site and also went to the neighbors’ house after dusk to visually see the “glare” from the sign
Anita Yarder stated numerous people have commented on the sign and they like it.
Jim Rhodes asked what is the violation. Is it the sign, no permit or the light?
Fred Greitzer asked why the church and the neighbor can’t agree on the lighting issue?
Margaret Olkowski and Jim France live directly across from the church and the lighting is not a problem to them.
Dave Massimi recommended to the ZBA that the variance be granted, sign was constructed in good faith, once applicants were told they needed a permit, they applied for one.

It was brought up that the board is still in need of an alternate member. The members present felt it should be a woman and from a part of town other then rest of the board members.

Tamulonis - Z2010-2 Use Variance for fence at 487 DeWitt Mills Rd. Kingston.
Daniel Tamulonis presented survey map, pictures and drawing of property showing what he was looking to do. Ron Parenti questioned that fact that the application said one thing and Mr. Tamulonis wanted something else now. Mr. Tamulonis stated the plans for the fence along front of house changed after he spoke with the County Highway Department and was told of the 25’ right of way the county has from center line. The height changed because the 60’ long section of 10’ high was set below a bank.
Originally a 6’ fence along approx. 60’ road frontage was requested, now you are amending to 6’ high for approx. 30’ and 10’ high for approx. 60’ along the front of the property. Ron Parenti pointed out that Mr. Tamulonis was asking for 2 ½ times the allowed height for a front fence and almost twice the side property height allowed by Code. David Soman questioned if the fence was outside the 25’, because it did not appear to be on the drawing.
Fred Greitzer mentioned that there was a similar case in town, but could not remember where. Ron Parenti asked the substitute clerk if she could look it up.
It was also stated that it might have to go in front of Ulster County Planning Board because of it being on a county road. Christopher Pryslopski suggested that Mr. Tamulonis have the County highway give him something in writing that states it is not a line of site issue.
Ron Parenti suggested that Mr. Tamulonis stake the fence line out and hang a sting from one end to that other at the height he wants. After he does this to let the board know so they can do a site inspection.
Ron Parenti told Mr. Tamulonis if he files an amended application in a timely matter with the correct information then a public hearing can be scheduled for Sept. 20, 2010.

Victoria Gardens –#Z2010-1- Use Variance
Written comments were received from the County. No County impact
County recommended changing the application to an Area Variance. Leslie will take care of the paperwork.
After reviewing the Ulster County Planning Boards recommendations a motion was made by Ron Parenti, seconded by Robert Hendrickson to grant Victoria Gardens an Area Variance to place three signs as specified in the application at her place of business.
