TOWN OF ROSENDALE ZONING BOARD OF APPEALS
MINUTES OF THE AUGUST 21ST, 2007,  MEETING (DRAFT)
 
Chairman Robert Hendrickson called the meeting to order at 7:30 PM at the Rosendale Community Center with the pledge to the flag.
 
I. ROLL CALL:

 Also present:  Fred Greitzer, Planning Board Liaison
             Kevin Hines, Fire Marshall
 
II. MINUTES OF THE PREVIOUS MEETING, July 21, 2007
Fred Greitzer advised that in regard to Jeffery Tirsch, there was a notation that the board members should look at the sloop on Mr. Tirsch’s property.  Mr. Greitzer advised that the correct spelling should be slope, not sloop.   John Maylie made a motion to accept the minutes with the spelling correction.  Robert Hendrickson seconded the motion.

III. PUBLIC HEARING: 
 Jeffery Tirsch, Z2007-04, 459 LeFever Falls Road, #62.4-5-8, Rosendale
 Fire Marshall, Kevin Hines, looked at the Tirsch property and advised that the corner of the proposed shed to the house is approximately one and a half feet.  Mr. Tirsch showed on his map that the distance is actually five feet from the proposed shed to the house.  Mr. Hines expressed concern about fire apparatus getting to the house in the event of an emergency due to the distance issue.  Mr. Maylie advised that the Town Code says that the shed can be moved closer than five feet to the house.  Mr. Hines advised that whichever code is stricter, the Town Code or the State Code, overrules.  John Maylie noted that if Mr. Tirsch moves the shed closer to the house,  the variance request will be less substantial.  Mr. Tirsch noted that if he moved the shed closer to the house it would restrict him from access to his deck.  Ron Parenti asked if the proposed shed would be uses as a garage in the future.  The shed would be used for storage, however, it was a possibility that he may use it as a garage in the future.  There was no public input.   Kevin Hines would check the local fire code and advise the secretary of his findings before the next meeting.  Robert Hendrickson made a motion to close the public hearing and advised the applicant that a decision would be made within 62 days.

IV. OLD BUSINESS:
 Roy Judson, Jr. - Rosendale Self-Storage Unit, 2546 Rt.32, Bloomington
John Maylie advised that the Board send Mr. Judson a formal letter on the Board’s decision.   Fred Greitzer noted that Mr. Judson did not have an application before the Board as he did not pay the full amount due for the application submission.  Partial payment was made and at the last meeting Mr. Judson took the balance due of $5.00 back and retracted his application.  Chairman Hendrickson felt that the Board still wanted to clarify the situation regarding the storage units. The building permit letter sent by Building Inspector, Richard Giebelhaus, on March 24, 1999, to Mr. Judson was read by the Chairman.  The letter stated that the building permit was approved with the scope of work including the following: The renovation of existing structure Building A into 14 unit self-storage building with the exterior of the building to be cleaned and painted.  The construction of buildings B, C and D as per drawing of Trachte Building Systems, Inc and site plan development as per plans approved by the Town of Rosendale on November 5, 1998.   The letter did not specify any storage of vehicles on the property outside of the storage units.   A letter would be sent to Mr. Judson advising him to reapply to the Planning Board for a site plan amendment. 
 
V. NEW BUSINESS:
 Charles T. Klepeis, Z2007-05, 300 Grist Mill Road, Tillson, NY, Tax Map #71.1-1-29.2
Mr. Klepeis has submitted an application to the Board requesting construction of a 20 X 28 cabin home on his property located at 300 Grist Mill Road, Tillson.  Mr. Klepeis was denied a building permit as he was not in conformance with the zoning density control schedule #75-11.   Mr. Klepeis has 2.6 acres and is looking for 4 tenths of an acre relief.  The property is in an A1 Zone with 700 feet of road frontage.  The applicant has no immediate plans to subdivide the property. 
A public hearing is scheduled for the next meeting, Tuesday, September 11th, 2007 at 7:30 PM.
