NOTICE OF PUBLIC HEARING ON A PROPOSED ZONING FOR A FORTY-EIGHT UNIT APARTMENT PROJECT BY ADAPTIVE RE-USE OF THE FORMER TILLSON ELEMENTARY SCHOOL FACILITY BY FORTUNE 488, LLC.

PLEASE TAKE NOTICE, that pursuant to New York State Town Law, New York State Municipal Home Rule Law, Town of Rosendale Local Law No. 1 of 2015 and Article IX of the Town of Rosendale Zoning Law, a Public Hearing will be convened by the Town Board of the Town of Rosendale at the Town Hall, Rondout Municipal Center, 1915 Lucas Avenue, Cottekill, New York on the 9th day of December, 2015 at 7:00 p.m. on the proposed Zoning Amendment and attendant Zoning Map Change which has been introduced upon the Petition of Fortune 488, LLC in accordance with aforesaid statutory authority; and,

PLEASE TAKE FURTHER NOTICE, that the said Zoning Petition has been introduced before the Town of Rosendale Town Board for a Zoning District Change of 8.4 acres of the former Tillson Elementary School premises from R-1/R-2 Zoning to Economic Enterprise Overlay Zone (EED) Community Development District (CD), together with the accompanying Zoning Map Amendment, for lands and associated structures thereon, currently owned in fee by Fortune 488, LLC and being situate along Grist Mill Road in the Town of Rosendale [S/B/L # 70.12-3-8]; and,

PLEASE TAKE FURTHER NOTICE, that the above referenced lands are more particularly described as follows:

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in Tillson, Town of Rosendale, County of Ulster and State of New York, and more particularly described as follows:

9)  thence along the Easterly line of lands of Bradley North 8° 43’ 21” East, 213.44 feet to a recovered monument;

10)  thence North 2° 19’ 21” East, 35.63 feet to a point on the Southerly side of Grist Mill Road;

11)  thence along the Southerly side of Grist Mill Road and partially along a bluestone retaining wall, the following courses and distances:  North 60° 59’ 21” East 128.17 feet to a point;

12)  thence North 67° 33’ 21” East, 33.22 feet to a point;

13)  thence North 79° 27’ 21” East, 17.95 feet to a point;

14)  thence North 86° 22’ 21” East, 28.11 feet to the place of Beginning.

Containing 8.448 acres; and

PLEASE TAKE FURTHER NOTICE, that pursuant to NYCRR Part 617.4 of the State of New York Environmental Quality Review Act [SEQRA] Regulations, the action has been classified as Type I by the Town of Rosendale Town Board by circulation of its September 21, 2015 Notice of Intent to Serve as Lead Agency for review of the project; and,
