Minutes: The minutes of the December 9, 2002 meeting were approved.

Reports of Committees:

Motions: To allocate the sum of $250 (two hundred fifty dollars) from this committee's budget for the development of photographs, was approved.

Points of Information, without division:

that the chairman and member Dietrich Werner met the previous week with Peter Fairweather, proposed consultant to the committee, for the purpose of planning the next steps of the committee's work, with the intent of preparing a draft scope of work to present to the committee, in order to define the contract between the consultant and the town of Rosendale; question regarding the timing of this step, answered that an extraordinary meeting of the committee might be advisable to expedite it; that this committee will lead the planning process, with the assistance of the consultant; that extra copies of the citizen survey are available; question regarding the possibility of putting the survey, or at a minimum the overall results, on the town web-site; that the extraction of survey written comments has been completed; that the chairman will prepare graphic displays of the survey results; that additional photographs, other than from the 50 cameras already allotted, will be accepted; question whether extra-town photographs will also be accepted,answered in the affirmative; that the chairman will request financial assistance from Wal-Mart for film processing; that there appear to be some contradictory anomalies in the survey results;that clarification of some responses to the survey is necessary; that geographical considerations constrain certain aspects of development; question as to the relationship between this committee and the "smarter land-use" working group; question regarding quorum and motion requirements, to be referred to the town attorney by the liaison to the committee; that the Cornell Land-Use Resolution Center is available to assist with the proposed hamlet meetings; that this committee needs available to it the current town zoning code, and that the liaison to the committee will arrange therefor.

Points of Information, without division:that the Rosendale Town Board plans to approve the contract for scope of work with Fairweather Associates at its next meeting March 12, 2003; that the chairman et al met with Peter Fairweather; that GIS information is to be supplied by Ulster County, for a savings of approximately $35,000 to the town; that historical materials and photographs are available to comprise a history of the various town hamlets, including inactive mine maps; that the photoshoot is proceeding, with publicity posters displayed;that approximately one-half the available cameras have been distributed at this time; that copies of the zoning code are now available; that a reanalysis of the survey results has revealed some discrepancies with the raw data, to be resolved by a third interpretation; that extracted written data from the surveys is now available; that NYS Natural Heritage Program has material available, accessible only to DEC, Ulster County EMC, scientists, and others on a need-to-know basis;that information is available to this committtee from the "Smarter Land Use" meetings, and that the secretary has taken possession of this material; that the Rosendale Historical Society and the Rosendale Environmental Commission held a joint meeting, for the purpose of resource inventory; that a special meeting be scheduled with Fairweather Associates, in advance of this committee's next regularly scheduled meeting; that run-off water quality standards are now in place, with SPEDES permit requirements, and a mandated educational program; that space is now available on the town web-site for survey results, reports, etc.; question regarding space requirements for this committee's subsequent meetings; question regarding standards for historical preservation listing.

Motions: that a public participation and outreach committee be formed,

comprising Attilio Contini, Gary Schwartz, Dietrich Werner and Patrick McDonough, to which the consultant will contribute; to schedule public participation meetings at the Tillson, Cottekill, and Bloomington fire houses, and possibly the recreation center; and to develop press releases, posters, etc., regarding same; was approved.

that the following committee work schedule is proposed by the consultant:

December - submission of draft plan, ready for public comment that the committee chair and the Environmental Management Council met with the consultant regarding the GIS; that the county will provide mapping at no cost to the town; question as to the structure of the public participation meetings; question whether such meetings should include proposed solutions; answered in the affirmative, for items with clear mandates from the survey; that 16 photo-shoot cameras have already been returned, with 5 sets of other photos, and 11 cameras unused at this time; that member Dietrich Werner will contact those who have not yet returned cameras; that the secretary will send a status report of membership attendance to the committee chair and the town supervisor; that the secretary will verify town policy regarding meeting attendance.

That Denise Pitcher has resigned from the Town of Rosendale Comprehensive Master Plan Committee, which has been received by the Supervisor; and that Li Daniels has resigned from the Town of Rosendale Comprehensive Master Plan Committee, which has not.

Presentation:review by the consultant of Town of Rosendale census data.

Reports of Committees:

Scheduling committee: that Dietrich Werner be named chairman of this committee; that all public meetings are scheduled for June, for which see the planner's schedule; confirmed public meeting June 18 2003 at the Bloomington fire house; that the chairman of the Town of Rosendale Comprehensive Master Plan Committee will draft a communication letter announcing this committee's work; that the Town of Rosendale senior citizens' group would be interested in a presentation.

Motions

to combine the scheduling and public outreach committees, to set dates not yet confirmed and so to inform this entire committee, was approved; to include reference to the 1969 plan in the proposed press release, with the intent to review and amend zoning regulations, was approved.

that the which is a draft outline, an initial scope of document;

that the Rondout Creek is legally navigable;

that most currently undeveloped areas have constraints, particularly slope;

and that this is distinctive of the Town of Rosendale;

that preference exists for building single-family homes on slopes, despite cost constraints;

that critical environmental areas require further SEQURA review, but the which is not zoning;

that Town of Rosendale is a sensitive area, with little "elbow room" from the environmental standpoint;

that the citizen survey did not distinguish full-time from part-time residents;

question in regard to Route 32 development, was answered that photo shoot results pinpointed Route 32 development as negative examples;

question as to control factors needed;

question as to avoiding sprawl by setting positive goals;

that on p. 15 of the survey, question is ambiguous;

that a survey is not a plebiscite;

that difference exists with the current (1969) Master Plan in regard to preserving certain specific areas;

that inventory of legal contractual constraints on development is needed;

the which may not be identifiable on Town of Rosendale Assessor's maps;

that mined and therefore undevelopeable areas have not been identified;

and question as to sources of such information;

that Town of Rosendale is a network of small hamlets;

that the Main Street area (prior Village) holds singular importance;

that a Master Plan is a visionary document, not code;

question of open space vis-B-vis property-owners' rights;

question of desirability of cluster development;

that inventory of historical sites and features is needed;

question of Committee's need to examine agricultural practices;

that lakes and waterways be protected from visible development;

and that riparian buffer-zones are desirable;

that other area towns have established water-resource protection;

that groundwater protection is considered critical;

that well-head protection regulation is desirable;

that voluntary public access to water recreation is desirable;

that any final Town of Rosendale Master Plan should not require use of eminent domain;

that viewshed protection holds particular importance to the Town of Rosendale;

that density be tied to physical features;

that "dark-sky" regulation of lighting is desirable;

question of land use by ATV's and dirt-bikes;

that there currently exists no Town of Rosendale ordinance regarding trash-burning;

question of affordable housing;

question of identifying light-industrial sites;

that development guide-lines for industrial development are desireable;

question of Town of Rosendale festivals.

change on p. 2: Rondout Creek as public gathering place to Town of Rosendale Recreation Center; that appropriate scale refers to what already exists, and fits the location; that scale of development is a more preferable object of regulation than density;

that a farm is defined as comprising a minimum of 10 acres;

that much farmland has been lost, and the remaining should be rezoned as agricultural; and that programs exist to compensate farmers declining development; that lighting regulation shall be included; that ridge-line development is a current local issue;

question regarding legal obligations regarding and desirable regulation of logging;question of preserving scenic resources as for example regulating development of Joppenburgh Mt., answered that to be addressed through density and visibility regulation; question of low-income housing, answered housing should remain affordable,

and add to p. 3: encourage small multi-family dwellings; add encourage mixed use in all business districts;

add appropriate use of accessory apartments;

add protect aquifer recharge zone;

delete New York City as sole specific commuting destination;

and that question remains regarding provision of parking lots for buses, park-and-rides, etc.;

question of whether encouraging tourism worsens the traffic situation,

and question of whether tourism negatively impacts local quality of life, answered that tourism results in preservation of rural amenities;

question regarding rezoning of Rt. 32 commercial strip,

answered that compact mixed-use nodes are preferable alternative;

question as to who shall prepare zoning revisions;

question as to date of adoption of Town of Rosendale budget.

Review of and comments on submitted materials: that taxes are a concern; that the Town of Rosendale is developing a Capital Facilities Plan; that economic development often comes via existing businesses; that water supply is a critical issue, in regard both to the several water districts and privately-owned wells; and that sewage plant capacity may be more of a limiting factor than water availability so far as the Town of Rosendale water/sewer system is concened; and that figures regarding same will be obtained from Pat Marsh, Chairwoman of the Town of Rosendale Water & Sewer Commission;that the Ulster County Water Supply Advisory Board has designed an inter-municipal system, which has not yet received funding; that the plan be made gender-neutral, i.e. delete unmanned; that other public natural resource areas (Walkill River) be added; that item I4 be changed from municipal to public; that some taxes are directly decided by the voters, as for example the

Library and Fire Department; that there are three separate school districts within the Town of Rosendale; that it is desirable to reactivate the Town of Rosendale Economic Development Committee; that there is public sentiment that the status quo be maintained, and that this will require zoning to ensure; question regarding revising minimum lot sizes; question regarding adding Binnewater Rd. as a viewshed or as a gateway to a viewshed; question regarding reference to a 300' buffer strip in the 1969 Comprehensive Plan, and that any spot access to the Rondout Creek will require public hearings; and that this matter is separate from preservation of the D&H Canal, which is still listed by the Army Corps of Engineers as encumbered property; question requesting clarification of section E5 Creek Locks area; question regarding offering incentives for preservation of historically significant properties, offered not as a goal but as a recommendation; question regarding availability of a traffic and mobility study; question regarding desirability of individual large lots as opposed to cluster development; question regarding desirability of encouraging multi-family dwellings on large lots, answered that this is dependent on the specific physical conditions of the particular site; question whether this may not be termed "micro-zoning"; question regarding grandfathering of specific lots; question regarding additional small water & sewer districts; and that the next step in the planning process is to generate finalized goals.

Motions: That the Town of Rosendale Comprehensive Master Plan Committee recommends to the Town of Rosendale Board that the Committee remain at its present eleven Members, was approved.

Motions:

WHEREAS, the Comprehensive Planning Committee with due diligence has met on a regular basis and has followed both standard practice and taken a proactive role in gathering information and soliciting public input for the preparation of a Comprehensive Plan for the Town of Rosendale including but not limited to:

Conducting a well publicized written survey which was mailed to all registered voters, to all tax paying land owners and made available at the Town Offices;

Conducting a well publicized Rosendale "Photo-Shoot" to collect additional citizen input in the form of visual images;

Hosted two separate series of well publicized public participation meetings to allow for public input into the Comprehensive Planning process; and

Encouraged and incorporated public participation at all Comprehensive Planning meetings on a monthly basis over the past two years, and

WHEREAS, the members of the Comprehensive Planning Committee believe that they have conducted an open and well publicized process to the best of their ability and have gathered and compiled information that accurately reflects the opinions of the residents of Rosendale, and

WHEREAS, said information has been compiled into a Consultant's Draft of Plan Recommendations dated November 12, 2003 as prepared by

Peter Fairweather of Fairweather Consulting, and

WHEREAS, the members of the Comprehensive Planning Committee having met and a majority of members voting approval;

RESOLVED, that the Consultant's Draft of Plan Recomendations and copies of this RESOLUTION be forwarded to the Rosendale Town Board, Planning Board, Zoning Board of Appeals, Water and Sewer Board, Recreation Commission, Environmental Commission, Historic Commission, Building Inspector, Highway Superintendent, Water and Sewer Superintendent, Police Chief, Assessor, Rosendale Library, fire departments and/or any other relevant Town entity for review and comment, and further

RESOLVED, that any and all comments or recommendations on the Consultant's Draft of Plan Recomendations be submitted in writing to the Comprehensive Planning Committee on or before January 30,2003 for the Committee's consideration and/or inclusion in the preparation of the Comprehensive Plan; was approved; the division, recorded by subsequent Motion: 8 favoring, 1 opposed.

that minutes shall be posted at the Town of Rosendale Library; that e-mail may be sent to Fairweather Consulting @ fairweathergroup.com; that the Consultant and the Chairman will make a presentation to the Town of Rosendale Board at their Dec. 3, 2003 workshop meeting;that committee members shall submit written comments on "Preliminary Recommendations for the Comprehensive Plan, November 2003" by Nov. 30, 2003; that letters expressing gratitude for their cooperation and assistance be sent to the Bloomington Fire Department and Rosendale Hardware; question regarding status of Town of Rosendale tax base, particularly commercial properties; question regarding build-out analysis and fiscal projections; question regarding inventory of housing stock condition.

Minutes: The minutes of the previous meeting were approved as amended:

1) comments on the Consultant's "Preliminary Recommendations for the Comprehensive Plan, November 2003" may be submitted to this Committee until:

2) the division on Motion: from 8 favoring, 1 opposed to 7 favoring, 1 opposed, 1 abstaining

New Business: Received: Member comments on draft plan

Motions: that the Consultant's draft "Preliminary Recommendations for the Comprehensive Plan, November 2003" be made available to the public at the Rosendale Town Hall, was approved.

Points of Information, without division:

that the Chairman has created a master membership mailing list of all Town of Rosendale Boards, Commissions and Committees; and mailed them the "Preliminary Recommendations for the Comprehensive Plan, November 2003" with requests for their comments;

that this Committee shall await submissions from all other relevant bodies, and that all forms of comment shall be combined in order to streamline overlapping comments;

that constraint-based planning requires that density requirements should reflect actual buildable land,and that most easily-developable plots in the Town of Rosendale have already been built up;

question regarding the desirable level of detail in a master plan;

question regarding low-density developments,

answered that a conservation density easement is similar to the cluster development concept;

question regarding determining the carrying capacity of each parcel, in relation to Rosendale's

complex terrain;

question regarding minimum lot acreages in different zones;

question regarding the influence of bordering towns on Rosendale density;

question regarding development of eastern end of Main St.;

question regarding distinguishing Rt. 213 from the Main St. district;

question regarding development of sidewalks and bicycle trails;

question regarding open-space inventory, now being conducted under the auspices of the

Environmental Commission, including members of this Committee;

question regarding local resource concerns;

question regarding identification of all existing conservancies,

answered that no comprehensive public record is currently available;

but that vacant large (over 10 acre) parcels are identifiable, with discussion of several specific examples;

question regarding Agricultural Districts and concurrent restrictions;

question whether the comprehensive plan should address outdoor recreation access;

question regarding noise ordinance, answered that the problem is enforcement, and deciding whether decibel or nuisance criteria should be established;

question regarding maintenance of view-sheds as opposed to property rights;

and question regarding how much diversity is appropriate.
